Final guidelines are published following the revision of draft guidelines. Publication occurs around two months after the draft guidelines were published.

The Sentencing Guidelines Council published its first set of draft guidelines at the end of September 2004.

Magistrates’ court sentencing guidelines – published 12 May 2008

The Sentencing Guidelines Council has published the definitive guidelines. The guidelines will be implemented on 4th August 2008.

The first update was published on 15 July 2008 and includes new guidelines for 'Causing death by careless driving' and 'Causing death by driving: unlicensed, disqualified or uninsured drivers' and revisions to the explanatory material relating to the sentencing of 'dangerous offenders'.

The second update was published on 9 December 2008 and includes new guidelines for 'Theft and burglary in a building other than a dwelling' and 'Breach of an anti-social behaviour order'. This update also includes other small changes. The website version includes this update which is being circulated to all recipients of the guidelines. The guidelines included in this update will be implemented on 5 January 2009.

The third update was published on 13 October 2009 and includes new guidelines for statutory offences of fraud which will apply to offenders who are sentenced on or after 26 October 2009.  In addition, supplementary guidance has been provided in relation to sentencing health and safety offences following changes to the maximum penalty for certain offences that came into effect on 16 January 2009.
